All powers and responsibilities with regard to maintenance, repair, renovation, restoration and replacement of the condominium project shall belong:

  1. to the Harrington House Condominium Unit Owners Association (the Association) in the case of all common elements, as well as charges for water, sewerage, waste removal, telephone service (except for individual units) and common element electrical equipment. The expense of such maintenance, repairs and services shall be shared equally by all twenty-one unit owners.
  2. to the individual unit owner(s) in the case of any unit or part thereof, as well as those limited common areas for which exclusive use and enjoyment is restricted. The expenses incurred for such maintenance and repairs shall be borne exclusively by the unit owner(s) to whose unit(s) such elements are attributable. Plans for renovations to a unit that will impact on the electrical or plumbing systems, or involve structural changes, require review and approval by the Board of Directors prior to implementation.

Damages within an individual unit, resulting from malfunctions in services provided by common area facilities, shall be repaired at the expense of HHUOA. Damages from equipment failures, located in an adjoining unit, shall be repaired at the expense of the unit owner(s) wherein failure occurred.

Any common expenses benefiting less than all of the condo units, which are caused by the conduct of less than all of those entitled to occupy the same, or by their licensees or invitees, shall be specifically assessed against the unit(s) involved.

In general, the common elements include all physical assets of the building and its surroundings. Specifically, these assets include the exterior walls and balcony structures; those portions of the electrical and plumbing system that lead to the individual units and serve other common areas; the elevator; laundry; recreation and storage rooms; parking areas; main and floor lobbies; and the landscape.
